Samuel Githanda

Samuel Githanda is a Partner at Bowmans in Nairobi, specialising in tax law, tax dispute resolution, and transaction structuring. He advises on all aspects of tax law, including corporate income tax, personal income tax, transfer pricing, indirect taxes, and customs duties, leveraging his expertise from his experience as a tax associate at one of the Big Four Auditing Firms.

Samuel has advised a money remittance company on taxes applicable to money remittance services and a dispute with the revenue authority; a US-based multinational on the applicability of digital services tax and VAT on digital services in Kenya; M-Kopa LLC on a tax dispute concerning management and control of the entity; a UK-based confectionary multinational on customs implications of a smart invoicing scheme between distributors; Promasidor Kenya on advance tariff rulings and disputes at the Tax Appeals Tribunal and High Court; and various entities on renewable energy tax exemptions, SEZ incentives, indirect capital gains tax, carbon credit taxation, and employment-related tax implications including secondments and permanent establishment risk. He has also advised Africa Oil Kenya, Majid Al Futtaim, I&M Bank, Mobius Motors Kenya, Netflix, Airbnb, Google, and Uber on various tax matters, including disputes and advisory work.

Samuel holds an LL.B from the University of Nairobi, a Postgraduate Diploma from the Kenya School of Law, and is a qualified Certified Public Accountant. He is a member of the Law Society of Kenya.
